Housing Benefit/Council Tax Benefit was created by weasley
Hi,
My father is 90 years of age, he has received a letter to say that his housing benefit and council tax benefit has been stopped following an anonymous report that he has someone living with him.
We are not contesting that, he had a companion living with him for 2 years, his benefits were calculated as a single person, he has fluctuating memory and is in extremely poor health. He has no previous criminal record and has never committed benefit fraud, this has happened without intent to deceive. His son-in-law owns the house and knew that the person was living with him, so did social services, and both GP's. I hold LPA for dad, but I am unsure as to what the consequences will be, he has no savings, so any payback would be a no go, the landlord, has not written to dad to advise of any arrears of payment (rent) any ideas Gordon please.

You/he need to get face to face advice, there is little than we can advise about on the forum, you need a trained advisor who can communicate directly with the DWP on your father's behalf.
Normally ignorance of the requirement to notify the Local Authority is not considered, but if you can show that his memory and mental health problems were such that he couldn't reasonably be expected to have made the notification then this may help.
Do an internet search for "welfare advice" with his postcode, town or county.

As his son in law is his landlord he could face problems there too
if he hasn't informed housing benefit. You don't usually get housing benefit if
the property you live in is owned by a family member.
Best to inform them and get everything sorted in one go.
