Hallelujah! A miracle! My wife's health must have improved because the DWP has decided that she no longer needs enhanced care & mobility and is only entitled to standard care & no mobility; this despite having a progressive, incurable, genetic condition (for which there is no treatment) that has gotten worse since the original award 2 years ago. God save the Queen. MR here we come.
Do they not have to consider the previous Assessment and the previous Award? My wife was never going to get better so how can they justify reducing her benefits? Can we offer the previous Assessment as evidence for the MR?
Confused and B****y angry.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Quintus,
I'm sorry you and your wife are going through this
Even with the review form, that is supposed to be considered along with the previous PIP2, each reassessment is a stand-alone entity. The fact that your wife has only got worse since the previous assessment is not, in itself, enough for a new award.
You can certainly use comments from the previous assessment for the MR. Don't forget that an award will only be gained by showing exactly how/why points should be scored against the descriptors.

Hi Quintus
My sympathies to you and your wife. I am going through similar hell myself. No, they didnt consider the previous award two years ago in my case. It's like it never happened! Of course my MR was a foregone conclusion, but I have been working on my appeal and what I have been doing is using their comments from previous award 2 years ago and highlighting these to demonstrate that they already had evidence to support that award. What's changed except things getting worse?. The point I am making is if you have to go to tribunal (I hope your MR is succesful and you dont have to) then you can bring all this up then and all these would be in DWP bundle so yiou cn reference page numbers etc. Sorry for rambling on but just ploughing through this on my own.
