From indefinite DLA High Mobility low care to zero

I would appreciate so much if someone could help me please. I received a letter on Saturday from the DWP saying that I would not be entitled to DLA or PIP anymore. I go from indefinite Higher rate motability and low rate care to nothing. I feel devastated with this result, like so many others, my life depends on it. I should have never have been on my own when they came to see me. I received a phone call with a cancellation appointment for 2 days later. The person who helps me would not be available at such short notice, but I was persuaded to take it or else. So I did. I am to naive and trusted I would be okay as I was home. I guess I was wrong. There I was with a very young man with a computer looking like a business man, not like a health care assessor. He tricked me a few times and I knew he was not a good person, he was there to fail me and did not give a dam about me. The report doesn't say anything that I said to him that I couldn't do, just what I could do. He didn't even acknowledged the complete loss of feeling on my toe and leg due to nerve damage earlier this year. It's not in the report. This is just an example. I am terrible with papers and forms and understanding what it means. Where do I go from here? I can't stop crying. My GP is on maternity leave, she is the one who knows me well. I have an appointment with a new GP tomorrow, for health reasons. I don't know if I should ask for anything relating to this. Tried calling Citizens Advice all day with no success. These young man who came didn't understand anything about ME/Chronic Fatigue Syndrome, which is a devastating illness. That is not mentioned on the report either. So I don't understand any of this, we have medicals that are not medicals at all. I would be so grateful if anyone could guide me please. Thank you.

I am sorry you are going through this :(

PIP was deliberately made harder to get than DLA, in order to bring down the benefits bill. The criteria for the 2 benefits are very different and this is where we have seen some claimants who were in receipt of DLA go wrong.

You have two options now - you can ask for a Mandatory Reconsideration of this decision (with a view to progressing to appeal if necessary) or you can give up on this claim and make a new one (in fact, you can do both but it would be the decision on the new claim that went forward).

I suggest you have a look at our PIP guide so that you can understand the criteria against which you are being measured and how you might have answered the PIP2 questions. This, along with the assessor's report* might help you understand why you did not score the points you expected to.

You have 1 month, from the date of the decision letter, in which to get a request for Mandatory Reconsideration to DWP. The PIP guide explains how to do this.

* I am assuming from what you have said that you have a copy of the assessor's report. If you do not, it is worth asking DWP for it.

May I suggest that you bookmark/favourite this on your web browser now so that you can find it easily in future? This will allow you to return with further questions or comments about your PIP without having to start a new topic each time. Dear Mrs Hurtyback, thank you so much for your kind reply. I will read everything you suggested and see if I understand what I will be doing and where did I go wrong. I need to give myself the best possible chance, I find this assessments insane.

What would be the possible consequences of choosing both or which one do you feel would give me a better chance of succeeding.

In your situation, I might consider a new application if I feel that I made a very poor job of completing the PIP2 form. Of course you can send in more information for a MR but DWP do take the stance that whatever the claimant says first is the only thing they will believe.

On the other hand, if I felt that I had made a really good job of explaining my limitations, in relation to the PIP descriptors, maybe I would be happy to take my claim to appeal.

Of course, the final decision is up to you :)

Hi. I spoke to Citizens Advice in my area to ask them to help me with a Mandatory Reconsideration but they don't help with that. Just with the form or with the appeal. How bizarre this is. I asked them to help with the English to challenge the lying and missing information on the assessor report but would not be able to help. They don't have people to do that and I do not have the expertise or English to do that in a way that I will stand a chance. I was wondering if anyone knows how I can get help for this, please. I was also wondering if the GP should write a letter for this reconsideration or just for the appeal. I wonder if they ever contacted my doctor for information. When I filled the form my GP did not want to write any letters, she said it was their obligation to contact them for information and they would have to pay for that. I was told by Citizens Advice today that the GP approach was the wrong one. Any help would be much appreciated. Thank you.
