Ive finally had my decision yesterday. Daily living 11 points standard rate, mobility-12 points-enhanced rate for set period from 13/09/17 until 12/03/19. I am happy but I still have some doubts about how the decision was made. I will be grateful if you share your opinions.
1- / On the page 1 of the decisions' letter the last words are: '' Ive looked at your claim and decided:''. On the next page 2 is nothing- the whole page is blanked. On the page 3 the first sentence is: ''This told me the type of help, and how much help you need.'' It not clear which evidences told her and why.
2-/ in the certificate page is written'' Please read the enclosed DVLA leaflet'' but such as leaflet is missing. It's not a big deal but i have a feeling hat someone just packed some paper without necessary attention.
3-/ On my F2F assessment I went in my wheelchair and been accompanied by my career and my son. They've also explained properly my daily needs, which are completely scored unfairly. The doctors letters show that I will have at least 2 surgeries one by one and the recovery will definitely take longer period than 14 months. Can i ask for MR for that short period of time , for the unfair scored, and for missing information in the decision letter?
4-/If I go for MR will my DLA money be stopped or I will continue to take it as they have been stopped once recently and then renewed?

The only reason to request an MR is because you disagree with the Decision, either the points awarded, the length of the award or both, so ignore the issues with the Decision Letter, whilst annoying they are no relevant.

If you request an MR then you will continue to receive your new PIP award.

Be aware that an MR can re-make the original Decision, this means that they can remove points as well as increasing them.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Thank you Gordon! I have decided -will go for MR. First because the actual decision in the Decision Letter is missing, there is no explanation at all. Second- DWP has not paid any attention of ( or totally ignored )my written comments on the assessment copy which I sent them back.
If the decision maker cannot get something as simple as the decision correctly mentioned on the Decision letter, then this should throw doubt over whether others areas of the Letter are in fact, correctly recorded at all.

- You don' address prompting, assistance or supervision from someone else.
- You don't provide any reasons why you cannot use a microwave.

Eating and Drinking
- You don't explain why you need prompting only that you do

Managing Treatments
- Treatment has to be in your home so the physiotherapist visits are not relevant

Toilet Needs
- Again no explanation of why you meet the criteria

Dressing and Undressing
- Again no explanation of why you meet the criteria

Communicating
- You don't appear to be arguing with the points awarded

As a general comment you don't explain why you meet the criteria you have highlighted that you believe you should, what condition(s) is it? How do they effect you? When do they effect you?
