Has anyone any knowledge on whether i can appeal having my ESA stopped due to my work earnings going over the £115.50 allowed last year ?
I am on a zero hours contract so my hours vary as i work part time, however due to my holiday pay at the end of the tax year my earnings went over the allowed earnings by £4 a week.
I am appealing the decision and it is with the courts but i need to know if i have any legal grounds to appeal the decision ? I can't find any info anywhere ? thanks

These appeals are very black and white, either you exceeded the limits or you didn't.

Would averaging the holiday pay across the relevant period bring you in under the limit?

Are there any deductions that have not been taken into account by the DWP?
