So I have just had my mandatory appeal for PIP turned down and just feel like giving up. I don't know if I can face a tribunal and I think that they know this. In 2007 I was finished from work through time off with My arthritic neck. At the time I was working full time but of course I wasn't entitled to JSA or anything else because they take it from 2 years previously when I was only working part time and not paying a stamp. SHAFTED. Now this. I stated in my mandatory appeal letter that I don't think the Capita assessor was in the same room as me let alone listening to what I was saying. So now I cant Get PIP either even though I was awarded it until 2018 and things for me have got much worse. SHAFTED again. I have no money coming in and my husband is struggling to keep the bills going never mind looking after me too. Any suggestions or help would be really appreciated as I am at my wits end:(

The success rate at appeal is far higher than at MR, 10% at best versus 60%+, however, appealing will require effort and mental stamina.
Your post suggests that your are not eligible for ESA(CB) due to your NI Contribution history and ESA(IR) because of your husbands working. If this is the case then be aware that a successful appeal will only result in your receiving NI Credits, which count towards a Full State Pension.

As you have been turned down for any award an appeal to tribunal for PIP is a no brainer. If you have submited all your relevant evidence and you believe that you fit the criteria for an award ,then ,maybe, it is not the evidence that has let you down but the presentation.
You don't have to attend the hearing if you cannot manage it, if you can make your case clear for the panel to see, then they can make a decision on the paper evidence. Of course it is better if you can attend.
To often are genuine claimants bullied out of the awards they deserve by this system. It does take a lot of strength to see this through, but sometimes you have to fight for what you deserve.
