TOPIC: awarded pip enhanced rate care

awarded pip enhanced rate care 1 month 1 week ago #197075

i have been awarded enhanced rate mobility for 2 years, the hp said my condition could get better as i have been told by my doctor to take up anxiety therapy, the hp claims this could make my condition better, is it possible for me to ask for a MR, in regards to the length of the award, i scored 17 points for care

Yes you can request an MR but I have to warn you that we are not aware of anybody who has successfully challenged the length of the award when this has been the only issue.

even though i have been awarded enhanced rate care, i do disagree with some of the descriptors like socialising i was only given 2 points,, and feel i should score 8 as i find it impossible to complete this activity, also in regards to mobility i was only given 4 points, where i clearly stated that i have problems with navigation and following a route. my last dal award was for 10 years so i feel i should be given a much longer award this time

I can't really comment further about the award length, what I would say is that having an Enhanced award, I would not recommend challenging the points that have been awarded.

If you want to request an MR then this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

You will need to show that the existing award length is unreasonable based on your conditions and the likelihood of change, both better and worse. I think it unlikely that arguments over the length of your DLA will be helpful, the DWP will take the position that PIP is a different benefit with different criteria.
