Contributory ESA Appeal - Won, end of 365 period

Hi, I won my ESA Appeal and was placed in the WRG with a recommendation to not reassess me for a further 2 years, but after a month, DWP advised I was at the end of my contributory period so could no longer claim. Obviously, this has left me without the payment. The payments came to an end in January this year and we are obviously struggling financially but my husband does not want me to claim again as the whole process made my mental health worse.

I have just been told that I should have been approached to see if I wanted to claim income related ESA, is that the case please as no one did?

Also, I have been told DWP could have continued to pay my stamp which they are not doing.

I have just found out that even after paying in 45 years of stamp, I am not eligible for a full pension when I hit 66 and need to pay additional contributions for the next 5 which I can Ill afford so can I go back to DWP and see if they can backpay my Stamp or is it too late.

I welcome your advice please.

Yes you should have been contacted about receiving Income Related ESA. ESA(IR) is dependant on your household income, your savings and assets, and any hours that your partner works. See

Asset rule for ESA(IR)

24 hour work rule for ESA(IR)

Your ESA(CB) claim has not been closed, you are just no longer eligible for payment, so you should be receiving NI Credits!

My husband rang DWP (on my behalf) following your response. They are now going to send out the Income based forms, plus they are reinstating my NI Stamp and sending us confirmation.

At least I know my pension contributions are being taken care of!
