I came home today to a decision on moving from DLA to PIP.

I was rejected. Awarded two points and my DLA will stop on 10th October.

I am deaf with speech.

I got two points for wearing a hearing aid. This aid does not give me normal hearing. I am severely deaf in both ears through Illnesses as a child. I must lipread.

I was expecting to be turned down as I lipread and do not sign but their reason for turning me down doesn’t make sense.

‘I have decided that you can communicate face to face as you have no intellect or cognitive impairments’

For the life of me I do not see how my intelligence, memory or thinking can help me lipread someone with a walrus moustache growing over their mouth or a person who wears a burlap for example or even a young child.

Is it worth me even asking for a mandatory reconsideration?

Your post suggests that you do not have any other problems so this limits you opportunity to score the points you need for an award to just the Communicating and Mixing with others activities. See out PIP Claim guide for more detailed information.

The criteria for these activities is very specific but on the limited information you have supplied I would think you have a chance of scoring 4 points for each activity and a standard award.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Yes, deafness is my only issue.

The letter contains a break down of how they scored me. They had nothing at all to say about mixing with others which I would h e difficulties with as I live mainly in the hearing world yet I fit into neither the deaf or hearing world and float around the middle somewhere.

I went to a boarding school for the deaf where sign language was forbidden. My family aren’t deaf, the people I work with aren’t deaf. I can communicate with people I know well but have problems in group situations or meetings. One guy at work has to write things down for me as he has a speech impediment.

Whilst I have speech it is not perfect I often talk too loud and when it is very noisy like at a place with music I cannot regulate my voice in such a way that I ca n be understood by others. I don’t tknow why this is but it is mighty frustrating as as a result I seldom go out.

It is mostly the signing deaf who are awarded PIP rather than lip readers.

So. Will there be another assessment report that I need to see rather than the breakdown that was in the letter?

Yes there will be a PA4 if you had a face to face assessment and a PA3 if you did not.

I cannot phone them so I will write and ask.

I saw a list before that said people with hearing impairments were to be called for face to face interviews. I was expecting one.

Maybe they’re doing it a wee bit differently here in N Ireland !

I've just noticed the title of your post. sorry about that.

There is no legal requirement for a claimant to have an assessment, but not having one is either very good or very bad, in your case the latter, it strongly suggests that your PIP2 either did not include sufficient information about your hearing problems and how they effect you or that you did not provide information relevant to the PIP Descriptors that you were being assessed against.

The key issue for both of the activities that I mentioned above is a need for Communications Support, this is defined in the guide but basically means your needing someone to help you with your communicating with others and will be crucial to your scoring the points that you need for an award.
