Dear B&W

I was last assessed in 2015 , with chronic fatique syndrome ,anxiety and chronic depression.
I was only given 6 points at F 2 F interview.
I went to tribunal and was given 24 points and placed in the support group under the special circumstances rule.
I have just recieved a new ESA 50 form to fill out.
Since last time the cause of my chronic fatique has been found to be caused by a rare pituitary gland condition and tumour.
I had an operation in june to try and remove the tumour and am still recovering , i am still waiting to find out what further treatment i may need ,this could include radiotherapy treatment.
I didn't inform the DWP of new diagnosis or operation and am unclear about how this places me in regard to reassessment.

The form needs to be returned before my next appointment with my consultant and neurosurgeon so won't be able to give them all the facts.
I don't think i will score any points on the physical questions despite having pain and fatique
As i still have severe anxiety and depression i may do there.
Because of the recent op and awiting further treatment do the special circumstances rule apply and would be the best area to concentrate on?

Thanks Traybell.

Hi traybell,

We don't recommend relying on the Special Circumstances clause unless you have no alternative. If you do need to reply on this you should pay particular attention to the part of the guide that explains this.

Nothing on this board constitutes legal advice - always consult a professional about specific problems
