Hi all
I continue to read things on the internet regarding having medical with atos or mandatory reconsiderations. In my opinion it is just made deliberately so difficult for people that they give up even things on the internet about benefit and works site saying they will give you tips on how to trick the system or give you answer to cheat the assessments which is ridiculous to suggest. benefit and works are here to help genuine people to put things into words to help people who otherwise would not get any help and it is exhausting thing to have to do not everyone can help themselves as it's a mine field dwp I have fought them all the way and what I don't understand is why?
We know there are people out there that are defrauding benefits and tax payers we get that what I don't get is why everyone even those with severe medical problems are treated the same way?
I have been through all this for last 2. Years having 2 assessments from atos 2 mandatory reconsiderations and 1 tribunal I have sent 42 pieces. Of evidence and how my illnesses affect me not just from my say so from my consulatants surgeons gps occupational therapist physio therapists all the surgeries I have had and more surgeries I am going to need this cannot be faked like most people on here who have been ill for a long time with medical evidence to back it up and the worst thing of all is...... that the dwp are not trained to know how anything is diagnosed or how it affects you so how can they go against all your medical evidence and not use 42 pieces of information from your specialists well that was me when I went this last time to atos I insisted on getting a copy of her report and she clearly states( bearing in mind the assessor is not qualified to diagnose anything) but on her report she says she has looked at 42 piecess of medical evidence but has not used it in her report ? and still try Making me accept a lower paid benefit that I should be on the enhanced rate people frightened to death of challenging a decision just because they are scared. Of been taken off and awarded no points at all. but f you don't report things then that can get you into trouble too. So brings different problems from dwp for not reporting changes
I. Did report mine and they then moved me onto high rate of care and low rate of mobility which I was not happy about and was given advice the same don't challenge it as you could lose all your benefit but I went ahead and challenged it anyway
This is absolute proof that they are doing their utmost to make it as difficult as possible and trying to get claimants to take a lower rate and think oh well at least I get something, but if you are entitled then it's not fair that you should accept it when you need more help and can prove this
I started my journey 3 years ago I followed through right to tribunal where because it took a year to get to tribunal my illnesses wasn't diagnosed a year before so had to accept it but now again just recently started again as I had more problems now then. They came back and said high rate of care and low rate for mobility so I challenged them again and finally got. What I think I should have got in the first place which is high rate care high rate mobility and even with all that evidence they had they tried every way to try get a get out clause they even rang my gp which he had already submitted evidence but in the end they had no choice it was down to me to prove it which I did now it was down to dwp to prove that I didn't which they couldn't but they will still try other ways like they can call you in for assessment earlier if they want to some up to a year before you benefit expires which is crazy how can they get away with that just like they are costing government more money by continuing to send people for assessments that shouldn't have to be re assessed as they have all the evidence they need and it is unlikely that they are not ever going to improve.so the advice is on here to assist you in your fight to word things correctly show you how to complete forms give you advice on. The different stages you have to go through and all the mandatory reconsiderations and tribunals that you might have to do and is quite a scary and uncomfortable process to go through and all this when you are exhausted and just need some advice and for this the benefit and work website gives you more than that it gives you advice and confidence to carry on knowing that they are there to help so keep pushing forward and hope that at some point that the government is going to stop going after the genuine claimants and deal with the ones that clearly fraudulently claim
