Extra Medical Information .Where to send it....

Hello Again..

Well Folks, at last I am starting to get some VERY good medical information back from my Wife's Specialists / Consultants, which is now up to date, and should be VERY helpful if we do get a Tribunal Hearing soon.....

So, my question today is....
Where do I send this new information to get the best result........

The reason I ask this, is when I spoke to a " Supervisor " at the DWP, back in July, when he called us to explain, just WHY the M.R. was refused a second time, and to be fair to him, he gave me a lengthy explanation overall. He distinctly said, I could always send in Extra Information to them, BEFORE we get a date for the Tribunal, and they MAY change their decision and award my Wife the Daily Living Allowance, if the evidence is strong enough, and we can then cancel the Tribunal Hearing, obviously we would have to put that in writing then......

However, on the Tribunal Bundle of papers I have here, it clearly says to send ANY further Information directly to them.....

So which is the correct avenue to go down here please.....

Any advice would be appreciated......

The DWP person is incorrect, you must only communicate via the Tribunal Service.

Sending documents directly to the DWP could mean that there are discrepancies in documentation available to the panel at your hearing which will almost certainly result in an adjournment to sort it out. The Judge won't be very happy about this!

That was excellent advice indeed, and I'm glad I asked the question on here now, as I was favouring the DWP route TBH, simply so my Wife wouldn't have to be put on the spot again, after already having gone through 2 WCA's for ESA, and then that damn " Health Assesment " farce of an interview for PIP too......

Hopefully, plenty more Medical Information to come, and will all be sent to the " Tribunal " now....

The Tribunal Service will send a copy of any new evidence to DWP, so there is still a chance of them changing their mind. It is not common but it does happen.

Thank You Again Mrs Hurtyback.....

We have quite a few more Consultants / Specialists appts: coming up, and the last one ( ATM ) is in late October, so we should have even more " Extra Medical Information " ready by then. Just wonder when we are likely to get an actual date for the Tribunal Hearing. Any ideas how long the wait is nowdays here down in Wales.....

Phone the Tribunal Service, they may be able to tell you waiting times for your area.
