Hi everyone! I hope you can give me some advice.
I have been looking through the forum for a few days. I can't find anything exactly the same circumstances so here goes.
I have been on income related esa since March 2016 due to me and my husband not able to work my husband is my carer. Due to being in hardship we had to sell our house as we owed money to family and friends + the council for a loan that was for Mortgage repayments while my Esa claim was sorted out, we fought off repossession off in September 2015 after my husbands business failed early 2016 we owed thousands of pounds out to family and friends, we really didn't have a choice but to sell the house.
It took a 18 months to sell so borrowed even more from my husbands brother and sister! A couple of days after the move I called Esa to tell them we had moved into local authority housing they asked a few questions I told the lady we had to sell our house immediately she said she was suspending my Esa claim and to send 3 months bank statements and the completion certificate I asked why she said your on income related Esa a couple of weeks later a firm came asking me what were the payments made to family so I filled it in and sent a letter explaining who and why the payments were made I called them last week to see if they had received it now they have sent me an Esa 3 I'm confused it says a new claim do I need reassessing I don't have any savings I had about £1000 for carpets but have had to pay that in rent now I'm pennyless I made a claim for housing benefit but they won't process it until Esa make a decision we are living on monthly pip and my husband carers can you help explain if this is usual practice to stop my Esa just like that?

They are assuming that you had capital from the sale of your house, wither in excess of the £6000 limit or even the £16,000 one. Normally this is disregarded for 26 weeks but your post suggests that it is more than this since your sold. So there are a number of issues that they will want to investigate.

It may well be that there was no capital realised from the sale in which case it should be sorted quite quickly.

Whilst it shouldn't, the suspension of your ESA can effect any Housing Benefit you receive so keep an eye out for this and contact your Local Authority if there is any issue.

You may be able to claim Hardship payments while the DWP make a Decision of reinstating your ESA.
