The ATOS HCP lied, what can I do? was created by Heather
The HCP for my PIP assessment wrote in his report details of a series of memory/ cognitive test that I could do. They never took place. The assessment was at my home, my daughter was present and she recorded it. There were other dishonest statements and there is cast iron proof on the recording. I was awarded standard PIP for care and mobilty. I asked for a reconsideration, sent in additional supporting statements from family members and set out what the ATOS HCP had lied about. I got exactly the same decision with exaclty the same reasons back.
I want to complain about the DWP assessor as I have pointed out to them that a fraud has been committed, yet they have taken no action at all and have still relied on this fraudulent evidence. What address do I write to at the DWP? I do not want to phone as I cannot use the phone.
I know that I can make a complaint to the HCPC but I understand that I can also report the HCP to the police for fraud. How do I do this and will they take this seriously?
Is there anything else that I can do?
This is the third time that this has happened and this time I am not going to let the HCP get away with it. I will be putting in an appeal but quite honestly I am too ill to go to Tribunal. It will be the third time at Tribunal.

I'm afraid I do not believe that there is any opportunity for you to report this person to the police for fraud, even if you can show that the discrepancies in the report were intentional, which is not a given as they could be ascribed to poor memory or referring to the wrong documentation when they produced the report, you must also show intent and being realistic, you are never going to be able to show this to a standard acceptable for a prosecution.

You will be far better of reporting them to the HCPC, if there license to practice is removed then they will no longer be able to operate as an assessor.

You can request a Paper appeal, which you do not need to attend but statistically you are less likely to be successful, or you could ask for an Oral hearing to be held via video link or the telephone.

I also have seen a reference on my medical report to a memory test which I didn't have, (apparently I failed it). It is wrong they d this to back up their reports.
