I'm in the process of claiming pip for my grandson 16 yrs old he has attachment disorder and was recieving dla in january17 he left my home and returned to his mother who then rang and stopped all his benefits then two weeks later kicked him out he returned to me so I rang to get his benefits returned which took weeks for tax credits and child benefit but his dla was being investigated I kept ringing with no joy only finally to be told he had been passed to pip which wasn't due to happen until 17th October he has had no payment since his Las one in January and have had two appointments for a face to face interview I rang and explained he doesn't interact and can get aggressive and violent he is very destructive but they said he must come I'm waiting to hear from them and half expecting them to cancel his claim they are also saying he will not be paid the back money from his dla I'm at my wits end as I work 16 hrs and do not qualify for anything to help care for my grandson I receive carers allowance but have been told this will stop 17th October I don't know what to do now can anyone advise please

If he was under the age of 16 when the mother cancelled his benefits and there was no legal obstruction to her doing this, for example you are his appointee, then she was legally entitled to do this.

However, if he was 16 or older and she was not his appointee then you can argue that she had no legal authority to close his claims and that the DWP erred in doing this, this may give you the leverage to get his DLA reinstated but I think that you will need the help of a trained advisor to do this. Do an internet search for "welfare advice" with your postcode, town or county.

He may be able to make a claim for ESA if his GP is willing to provide a Fit Note.

If yo do seek face to face advice then they may be help you with any other options that might be available to you.

Branden was under the age of 16 when his mother cancelled I was the one that applied for dla does this make me the appointee legally as his money was paid into my bank.

Not unless you were appointed by the DWP or you were legally made his appointee.

If the mother had legal authority to close the claim, then I think you are really going to struggle to get the DLA re-instated and you will certainly need to get face to face advice to have any hope of doing so.
