I have now got the date for the hearing its 16 Jan 2018, this is well over a year since I lost it. A quick question can I reapply in the mean time. I have a doctors letter saying she supports the claim and I have had an operation on my heart that has not worked, I have proof of this. Also I have had to move house because I find climbing the stairs difficult. I have also been granted ESA Support Group in July without a medical for an indefnate period using the evidence for the pip appeal. Will it effect my appeal for the back dated claim or is it best just to sit it out
You can but be aware that a new claim will create a new Decision which will supersede any Decision made at your Tribunal, so as a worst case scenario, if the Tribunal awards Enhanced for both components and the new claim results in no award, it will be the latter that is carried forward although you would have a new right of appeal.
