Hello folks

I need some advice please. Client was awarded no points. Mandatory recon asked for and complaint letter sent. She received a letter today to say she the mandatory recon has been overturned and she has been awarded standard rate care but has lost her mobility as she only received. Client has agoraphobia so she doesn’t leave the house. So do we appeal? Or just be happy that she got something?

Thanks

Chris

What does the client want to do?

You say that they are Agoraphobia, do they ever leave the house? If they have no walking issues then they are only likely to score for

e. Cannot undertake any journey because it would cause overwhelming psychological distress to the claimant. 10 points.

You may be able to argue that "cannot" does not mean never but the standard they will need to meet will likely be higher than the normal 50% of days.
