Also Gordon, as the assessor does not refer to any of the documentation I sent in as evidence (apart from the PIP form and my Occupational Health report), would you advise sending in copies of the documentation again with my MR?

Thank you

I would but also note on your MR that the assessor does not seem to have referred to the documentation when writing their report.

Thank you for your response Gordon. I have somehow only just seen it, after I had posted my MR about half an hour ago!! I have not sent copies, but I have mentioned it in my MR, I presume I can send the copies under separate cover, making sure I have my NINO clearly on each copy, or should I not bother now?

I have given reasons throughout why I feel a different descriptor should have been used where necessary and noted where I agree with the points given (sometimes no points)..

I was awarded a total of 8 points in mobility for moving around "can stand and then move unaided more than 20 metres but no more than 50 metres". I feel that descriptor e "can stand and then move more than 1 metre but no more than 20 metres, either aided or unaided" as I am unable to walk any distance without extreme fatigue, and repeatedly, due to the effects of my condition (Primary Biliary Cirrhosis). I had a home assessment and the distance between where I was sat, and where the HA was sat, I have measured to be 2 metres. When the assessment was over, the HA watched me walk from where I was sat to where she was sat (2 metres), she then went ahead of me for the remainder of the distance to the front door, another 4.5 metres (6.5 metres in total from my seat to the door). In her report she noted that I was seen to walk across the room with a normal gait unaided, with no sign of breathless (I have never once mentioned being breathless). She goes on to say "although she appeared fatigued, it is reasonable to suggest that she can walk over 20 metres". I have aske in my MR that they look again at the fact that she considered I was fatigued when she saw me walk (a distance I have measured as 2m) but yet concludes that it is reasonable to suggest I can walk over 20 metres. Surely this is a contradiction, and would indicate that I would be fatigued after 1m but before 20m? I have also mentioned that following the assessment I had to go and rest straight away.

Do you think I have gone about this the right way? How long does it usually take to get an MR decision lately?

I will start completing making notes for my appeal as no doubt it will come to this:-(

Thank you for your help.

One obvious question, you mention the distances inside their offices but the distance from the door to your transport?

Whilst the test is the claimants walking outside, someone who is restricted to 20m or less would be expected to have problems with walking indoors so can you explain what you do indoors. How far is the toilet and what problems do you have getting there and back? Where else you walk in the house?

Hi Gordon and thank you your reply. It was a home assessment carried out (without request), so the distances mentioned are inside my home.

I do walk small distances around the house, although never without increasing fatigue. We specifically moved to this house last year as it has a downstairs toilet. The distance from my front room to the toilet is less than 20m. I take my time walking slowly around the house, and have the comfort that once I sit down, I can rest, and sleep if and when I need to.

I try to do everything I need to do upstairs before I come down in the morning (if I get dressed, or have a bath/shower etc) and then the same once I am downstairs I stay there to avoid any extra journey up and down the stairs until I go up to bed or for a shower/ bath at night.. I have mentioned this in my MR too.

Thank you

This is information to include, but you need to provide accurate distances, you are weakening your arguments by simply saying that it is under 20m, it's a lot shorted distance than most people think. Also remember most trips in a house are two way but any recovery time in between counts as part of the time to do the "trip".
