I recently won an appeal on behalf of my nephew, who had his PIP removed, from having full Dla and mobility components to no PIP. The appeal panel reinstated his payments after 16 months of pure torture. He is a young man, and was given dla from being only 10 year old and did not have a review date.
The appeal reinstated everything with a view that it was not appropriate to put a period time limit. I now find that the dwp have put a time limit with the reason that PIP would be reviewed to assess whether his disability has got worse or a change of circumstances which he is required to notify the dwp anyway. Is this appropriate that the dwp have seemingly ignored this finding of the appeal pannal? I have to respond really quickly on this one. Do I have recourse to challenge the period of time.

You say the DWP have limited the award, what does the letter say?

The decision notice from the tribunal says: para 5. That the claimant is entitled to the mobility component at the enhanced rate from 23/11/2016. It is inappropriate to fix a term.

He Dap pip letter says entitled for an on going period. "Although Personal Independence Payment has been awarded, you only be entitled if you continue to meet the conditions of the benefit. We will contact you after 6 October 2026 to make sure you are receiving the right level of Personal Independence Payment.

He is in receipt of the enhanced rate of both the daily living and mobility component.
The disability is inherited and will get worse not better.

He receives the enhanced rate the affects of his disability is permanent so things will not get better.

This is the standard DWP wording for an On-Going award, so they have implemented the Tribunal Decision.
