ESA/PIP further help needed. was created by pablo
Hi all.
I’m hoping someone can give me some advice as to my current situation.
I was diagnosed with bilateral dysplasia and have had one hip replacement and am awaiting the next. I won my PIP tribunal and the judge gave me the benefit until the end of Jan 2018. I should have had the 2nd hip replacement already but the NHS delayed it even though it was medically diagnosed that i needed both hips replacing. I’m still waiting for the operation, which will probably be sometime in December. Now this will only give me a month recovery which is no where near long enough. Its taken me the best part of 6 months for my operated leg to get to a level that i would feel safe going back to work. (i work in construction industry, or used to, as have not worked for about 14 months now).
Can i get the PIP extended until its physically possible for me to work, and can i do the same for ESA as well. what should i be doing now to try and extend the benefit as i had to appeal originally against the DWP due to the fact they lied when i had my assessments and i am not sure i can face going through that whole process again. It was 9 months of misery getting the DWP to change their original decision. Can advise what i need to do as i feel i should be allowed to keep the benefits i have been given until i am able to get back to work, which is something i am desperate to do but not until i am physically up to it. I thought my recovery was doing great, and dropped my guard for 2 seconds after 3 months and basically my hip new hip gave out and i fell over fracturing my wrist into the bargain! 4-6 weeks is not enough time to recover and i need longer. Any help would be much appreciated.
Kind regards
Juan

Hi Pablo,

I'm afraid I know of no other way of extending a benefit other than going through the reassessment when it comes round! This applies to both PIP and ESA.

I would expect you to get the reassessment forms 2-3 months before the award is due to end - although there seem to be some delays with ESA reassessments in some places - so the PIP will probably be with you soon anyway..

The first thing you need to do is to contact the DWP office dealing with your PIP claim to find out whether they intend to contact you about reassessing your claim. If they aren't then you need to make a "new" claim for PIP by contacting the POIP Claim line.

www.gov.uk/pip/how-to-claim

If they are going to reassess you then keep a careful watch out for the forms, they should be able to tell you when they will be sent.

As to your ESA, contact the DWP office dealing with your ESA and ask when you will be reassessed, the information should be on your computer record, you can then decide what action you need to take, if any.

PIP is not a work related benefit so you do not need to worry about your going back to work until your limitations contradict your award.

There are options for you to do a planned return to work with ESA, we can explain about these when you are considering a potential return.

Obviously if there is an improvement in your conditions then you must notify the DWP.
