Hello to all the members of Benefits at Work who contribute to or read the articles on this wonderful website which is highly informative, legally-educating and offers prudent and user-friendly advice with particular reference to those of us who are currently going through the trauma of having to apply for PIP.

I have just recently joined Benefits at Work and I would be most interested in learning how members who have already applied for PIP or who are currently applying addressed the issue within the “Managing Toilet Needs” section of their choice – or maybe their legal right – to use the toilet bowl to urinate as opposed to using such an aid as a Urinal Urine Bottle?

As Page 39 of the Benefits and Work Guide (Version 26 April 2017) clearly cautions: “Decision makers may argue that you could use an aid or appliance [e.g. a Urinal Urine Bottle] as an alternative to having supervision or assistance from another person”
I do not mind in the slightest whether answers come from males or females because irrespective of our gender this particular issue applies to us all!

Maybe some of the legal experts associated with Benefits and Work – if they read this article – could advise me and undoubtedly others if we have any legal rights on this matter and if not suggest ways in which we could defend our right as use the toilet as opposed to using a Urinal Urine Bottle.

Time is getting short for sending in my completed PIP Application and I would deeply appreciate your early responses. Thank you to all who responds.

The use of aids and appliances can be assumed where it is reasonably for the claimant to use them, so you need to either show that you cannot use a urinal bottle or accept that you may be assessed on the basis of being able to use one. Remember, it is not just a case of using the bottle but you may be able to argue that disposal and cleaning would also be issues.

Also, the use of aids only applies specifically to Descriptor (b)
