My health had deteriorated so pip say let us no if things change so i did i had 2 more years still which was granted on my previous appeal i had to have another assesment for which according to the assessor all was great she put in her report lies as she states she asked me to carry out tasks and that i did without any problem couldn't believe what she put from enhanced mobility high rate to pefect bill of health when in fact my issue had got much worse couldnt manage to do anything alone they state in there rules incorrect information you will be prosecuted they're a absolute joke they can lie though on their assessment.
So they stopped my pip can they do this when i still had 2 years to go?

If you reported a change in your conditions then I'm afraid they can do this.

If you want to challenge the Decision then the first stage to doing so is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Hi gordon thanks for the information,i have already done the stage of the mandatory appeal refused just a copy of what the assessor put in her report they say if ive a problem complain to capta my friend did this on my behalf still no reply from them after 4 weeks!!
What do i need to do now ?
I cant go out so what do i need to do now?

If you want to pursue the matter further then the next stage is for you to request an appeal.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

Hi thankyou for info i have the sscsi form and with help filling it in section4 about your representative i have a friend that does do things i find to much to cope with they say inthis section someone that nos about social security benifits well my friend doesnt but he is prepared to go to court if needs be on my behalf as due to my issues im house bound so do i put his name down on the form then itsays all mail will go to him?

Only complete section 4 if you have a trained advisor. If you find one after the form is returned then you can notify the Tribunal Service.

Your friend can still attend and give evidence if you want them to.
