Getting married but not living together

Hi, I’m currently in receipt of Income Related ESA, PIP & housing benefit. My partner and I have been together four years and are going to be getting married at the end of this month. However, we do not live together, never have done & have no immediate plans to do so after the wedding. My partner works full time and owns his own home, so I’m just wondering if us getting married is going to affect my benefits and if it’s something I need to notify the DWP about. All advice gratefully received

The issue is whether you are considered as being a couple, in simplistic and incomplete terms this is primarily about whether you live together, however it is likely that the DWP will assume that a newly married couple would be.

You have to tell them that you are getting married as it is a notifiable Change of Circumstances, you should do this is writing to the DWP office dealing with your ESA claim. If you can afford it send it be a tracked post so that you have proof of delivery.

In your letter, explain that you will not be living together, in particular that you and your husband will be retaining separate addresses. The DWP at want to investigate further but you should be able to retain you existing benefit payments.

Thanks Gordon, much appreciated! Do you think it would be necessary or helpful to explain why we are not going to be living together? My partner has Aspergers & it is really important to him to have his own space. We also live in different towns, albeit fairly close to each other, and I don’t want to leave the town where all of my family, friends and support network are and be solely reliant on him.

Yes you definitely need to explain why you are not living together.
