Hi , I am appealing a PIP from DLA non award. I complained about the Atos medical report (full of lies) and am awaiting a tribunal date. The reply from Atos advised the dwp to change discriptors on a few questions and was very appolagetic for their errors. I have not heard from the dwp since I got the papers for the tribunal, but a payment of £1057 has been made to my account from them. If this is back pay from a changed award, but not the result I hoped for when it goes to tribunal: ie low care but no mobility, when i believe I should get care and low mobility. Should the DWP ask if I accept this or if I still want to appeal ? Other words will the tribunal appeal be ended by the Dwp because of award has been made ? Also as I get CB ESA SG and possibly PIP will I automaticaly start to get the extra disability premium of ESA or do I have to ask for it ? Thanks x
The only way to know is to contact the DWP office dealing with your PIP claim.
If an award has been made and this enables payment of some of the ESA Premiums, then you will need to contact the ESA office dealing with your claim. The ESA Premiums are only payable if you are receiving Income Related ESA, you may be able to receive this as a top-up to your current ESA(CB).
