Medical Professional’s Right To Insist was created by ianinpain
Hi Gordon
If a PIP Applicant has stated in writing when answering a question, or questions, within the Questionnaire or verbally, during the face-to-face medical assessment, that they are unable to undertake a certain physical activity because - for example - it would be harmful to their safety or it would cause severe pain and the medical assessor insists that it must be done, would refusal to do so by the Applicant be deemed as a refusal to co-operate with the assessor’s request and therefore prove disadvantageous in relation to the number of points the Applicant would score for that particular activity?

I am waiting anxiously for the telephone to ring and hearing the voice of a medical assessor arranging a date and time for my face-to-face assessment! I would therefore greatly appreciate your early and highly-valued response to the aforementioned question.

You are entitled to refuse but if you do then make sure you explain why. I'm afraid that it will depend on the assessor as to how they treat the refusal we have seen them accept it as is but also on occasion penalise the claimant, so explain in detail.
