Hi I had to submit the appeal to tribunal for PIP of my wife late by a day.The last day for her appeal to be received was on Saturday.She is suffering from mobility problems and agoraphobia so she is unable to post the letter unaided.I am her carer and supposedly to post the appeal letter on Friday but I felt seriously ill with food poisoning on Friday,by the time I made it to the post office on Saturday at around 12.15 i was told that 24 hours delivery will be going out on Monday to be received on Tuesday .Given that appeals office is closed on week ends ,even if I had it posted on Friday ,the letter would be processed on the first available working day ,that is Monday.So Although theoretically it was late by 3 days calendar wise in working days time it arrived on the next working day.I got a reply from appeal stating that it was late and that DWP has to decide about it .Has any one experience from any similar situation and what happened in the end??.My wife received the answer to her mandatory reconciliation 7 days after the day the decision was taken and it took another week more to send her the report of HP from Atos.

I'm sure it won't be a problem, but if it is then they will write to your wife asking her to explain why the request is late, her being unable to leave the house should be accepted as Good Cause for the delay.

Thank you Gordon. I hope to be no problem .This appeal would be not necessary if HP of Atos was not only neglecting to add all we told him but he was totally dishonest recording the mini state examination he carried as 30 out of 30 and therefore no cognitive impairment .I was present and my wife actually had scored only 20 out of 30 ,I am presenting evidence with the appeal from the mini mental test she had at her GP with her scoring 21 out of 30..She is having a hearing impairment with hearing aids on both ears .At the medicals she had them displaced and she told to HP that .In addition she asked him to talk loud facing her face as she cal lipread him .In a few occasions she had to ask HP to repeat the question .Well HP wrote in his report she does not need aid to communicate verbally.
