Hello Gordon,
I have just had a thought, if for ever reason I lose my ESA could I appeal and extend the decision again, I am not expecting to lose it as I am worse now than when I was given it but you never know, if I did appeal would I still get my full benefit until decision is made, I am just trying to think of ways to get me through until my retirement. and does it take long to get the appeal.

You can challenge the Decision.

ESA is not payable during the MR stage but you can receive the ESA Assessment rate if you go onto appeal.

Sorry Gordon, it must be me but I don't understand at all what you mean by MR stage, and that ESA is not payable during this stage. but I will receive ESA Assessment rate if you go to appeal. Basically I don't understand any of this, What is MR stage ? and what is ESA assessment rate if I go to appeal. Sorry if I sound a bit daft but I can usually get my head around things but I cannot with this. Thanks John.

No problem.

So there are various stages to challenging a Decision that a claimant has to go through.

The first is a Mandatory Reconsideration by the DWP, this usually takes 5-8 weeks and your ESA is not payable during this time although you can claim JSA or Universal Credit, I would recommend that you get advice before claiming UC.

If the Decision is not revised at MR then you can appeal to the Tribunal Service. Once the appeal is accepted then you can request that the DWP pay you the ESA Assessment rate until there is a hearing, this could easily take six months,. The Assessment Rate is £73,10 a week.
