Hi,

I was wondering whether anyone could advise as to whether its a good idea to include the
Submission re: preferring Judge Agnew over Judge Jacobs in relation to planning and following journeys in regards to Mental health issues?

My concern is that if I submit Judge Agnews view then the DWP will just counter argue for the Tribunal to consider Judge Jacobs view which is not in favour of people who have problems going out due to mental health illness.

I was awarded 3 years and after 2 years I was reviewed and they took away my standard mobility and put me down to standard daily living. First time round I took it to Tribunal and they awarded me with standard mobility and the DWP already awarded with enhanced for DL.

My mental health has only deteriorated since the last submission for PIP however they have awarded me less on my review :-/ I have attempted to take my life twice already this year with 3 hospital inpatient admissions, 2 sections, an offocial diagnosis of Borederline personaility disorder ontop of depression and anxiety as well as symptoms of Post Traumatic stress disorder. I have high involvemement in mental health services as well.

I am unable to go out, when i have done it has had to be with my husband due to the impulsivity of my moods and behaviour when i experience high levels of anxiety, flash backs from being raped and assaulted by my mothers boyfriend who was sentenced to 5 months in prison for it, he is now out of jail recently. I am mostly housebound and the times i have gone out my husband has had to be right there with me to stop me from putting myself or others in danger due to my emotional disregulation, chaotic mood swings and when I experience traumatic flash backs which makes me feel like i am reliving the trauma all over again. This is when i go into flight and fight mode. I experience suicidual thoughts near enough everyday.

If anyone can give me any advise at all I would be so grateful.
Feeling lost and anxious :(

If the Decision being appealed was made before March 16 then include a reference to the three Judge Decision made at the beginning of the year this supersedes the Agnew and Jacobs Decisions. There are details in the current PIP guide. Include a reference to the Case and any quotes that you think are relevant. Do not include the full Decision!

If it is was on or after the 16th then these Decision no longer apply due the change in the Descriptors and you will need to think of a different approach, again the guide covers this.

It sounds like you scored 10 points for Descriptor (e) of the Going Out activity. Realistically you are going to struggle higher for this activity do you have any problems with your walking?
