Closed claim, work programme still bothering me was created by moutainsandoceans
Hi,

I closed my ESA claim a month ago.

I notified the Job centre and the ESA people that I was doing so.

Then told Seetec by email.

I've been told by some people that I am not under any obligation to let these people bother me anymore, and can even report them. Is this true?

Thank you if you can help.

You don't have to respond once you stop claiming benefits, unfortunately as companies are only paid on placing a claimant in employment, expect them to chase you. You can make a complaint to your local JC+ if you wish.

I will do that. They left a message and mentioned I must get in touch otherwise I'll be sanctioned, obviously it seems it's a scare tactic if I'm under no obligation. And since I am not claiming benefit.

I wondered however;

1) If I have to claim Job seekers allowance at some point in the future, will I be placed right back on it? And will the apparent sanction carry over?

2) I'm currently in short term employment. Have Seetec been informed of this, since the DWP are notified by the HMRC that you are paying tax?

3) If I answer their calls seeing as you say, they will chase me up, can I just say I'm not claiming benefits and not working either. So they leave me alone? I mention that as I know if I tell them my employer details they will be in touch with them and my employer wouldn't like that.

Thank you for your help.

1. Even though you have no obligation to the Work Programme if you are not claiming benefits, you still technically remain on the WP for two years, so if you claimed a benefit again with that two year period you would continue as before.

You can't be sanctioned for something that you do not need to do, plus it is not Seetec that apply a sanction, only the DWP can do this.

2. They may have and this may be why they are trying to contact you so that they can claim the credit for the placement.

3. Yes that should be fine.
