Hi folks
It's my first time posting so apologies if I'm in the wrong topic!
To cut a long story short after a Capita assessment in April my move from esa to pip was reduced due to misrepresented information. For example I was asked if I went shopping alone and replied I had done it once in the last year and was so stressed and in pain I've not done it since and my son or daughter comes with me everywhere. I explained more or less the same in regards to hospital appointments where it has only happened twice in the past twelve months that I could not move appointments due to having nobody with me so struggled with that. This was used against me and reported I go shopping alone as well as to appointments. Due to this I was put on standard rate for both elements. The only upside was they could finally witness I couldn't walk more than 50 metres and finally awarded me 10 points for this after years of being refused due to 'evidence' collected from health professionals.
I asked for MR due to inaccurate evidence and asked for a copy of Capita report. I was told it had been sent out three different times but didn't receive a copy. I requested it again when sending letter explains my request for MR and agin never received it. This meant I had no detailed information from my assessment to be in a position to get further evidence. MR was refused and I was so exhausted mentally and physically that I couldn't cope with Appeal especially without health report, sadly.
Now I've received a Capability for Work questionnaire and not sure if this is related? I'm confused as I am the ESA support group or I thought I was until now. Any advices would be gratefully received as I am making myself ill with worry. Ive recently had to be discharged from my pain clinic as there is nothing else medically they can do for me. I have been referred to the Pain Management Program but even had to suspend that after only 3 weekly sessions as it is too much for me at this time. Apologies for the essay but my head is spinning right now!

Given the timescale I think this is just a normal reassessment of your ESA claim. IT will be a full reassessment so you must complete the ESA50 in detail and send any supporting evidence that you have even if you have sent it before. Please make use of the latest ESA Claim guides.

You can appeal the PIP Decision up to 13 months after the date of the Decision.

Thanks Gordon. Had a complete panic when I got the letter but found the claim guides and had a good read. Would it be unusual to be required to go for two medicals in twelve months? Seems excessive.

Regarding the PIP decision I thought I only had one month. I was told this when I was waiting for Capita report and they gave me a two week extension. I was under the impression there was only a short time to go to appeal. This is really helpful and I'm ready to go for it right now. How to I get a copy of my Capita report without be told it's coming and doesn't arrive! Do I contact Capita?

It's not that unusual, obviously the DWP expect your conditions to change.

If you appeal and it is accepted, you will need to provide reason for the request being late, then all of the documents used in the making of the Decision will be sent to you as part of the DWP's submission to the hearing.
