i originally was going to go to the appeal , but when months went by i phoned the tribunal and asked to cancel my appeal, but he asked if i was sure and if i was not going to go to the tribunal i should change it to a paper appeal ,i wrote a letter requesting a paper appeal. i was first awarded 8points for mobility the it was changed to 10 points on a mandatory decision , but the result from the tribunal overruled and gave me 12 points ,and at the end of letter it stated the dwp never requested a oral tribunal and so ruled on a paper only.

I cannot make up my mind whether I should attend a tribunal or request a paper one. Have you any idea which is the best way to deal with the matter.

Statistically attending results in a higher win percentage, but statistics don't really apply to an individual case.

So attending may help your case as the panel can ask you questions to better understand how you meet the criteria.

On the other hand, if you have Agoraphobia or Social Anxiety then your attending may undermine your case unless you can explain how you have managed it.

Can you please advise if we should have received a telephone call to explain their original decision or does this not happen to everyone now, as we did not receive a call?

Also there were two points in their original decision which we could not understand and made no sense at all and we asked for an explanation, which we did not receive from them when they replied to our Mandatory reconsideration. Perhaps you may recall this in my earlier post.

Regards

We are in the process of putting forward our appeal.

San

There's no requirement for the DM to contact the claimant, when PIP was originally introduced, calls were quite frequent but now they are only done on request.

Yes I remember, one was about hand grip and the other about cognitive ability and memory, I explained what they likely meant in a previous post.
