can anyone help me, i am my son`s appointee and today had a call from a compliance officer asking questions about my son, one of the questions was about my son`s bank account. the officer said that my son has 2 accounts.during the conversation i realised that they must know about a seperate account that his nanna set up for him but he has no access to this until his nanna says.they now want statements from both accounts,i know there is only£1000 in the account. the officer made me feel uncomfortable regarding this and stated as i`m the appointee i am responsable.to be honest i didn`t think that account would be a problem as he hasn`t got it yet, i am worried i will get into trouble because of this..

So is there any physical restriction on him accessing the account? If there isn't then it's going to be counted as his money.

What are his total assets and savings including the second account (you don't have to post them)? If they are less than £6000 then there should be no issue and you'll just get a wrap on the knuckles for not telling them about it, if it is more than £6000 then there could be an overpayment issue. If it is over £16,000 then there may be a more serious issue, as his entitlement to payment may be effected.

Not sure what you mean by physical? He has no access at all to the money which is a lot less than £6000. His nanna holds all the paperwork to it. I honestly didn't know it would be classed as savings. They've asked for statements and they will see nothing else as gone into the account or been taken out. As for his current bank they will see he is always overdrawn and therefore backs up why his nanna won't let him have it yet. As for the compliance officer I hope I don't get to speak to him again as he was very arrogant and made me feel like a criminal

If the account is in his name then it will be assumed to be his savings unless you can show that he has no access to the money, a statement that his nan holds all of the paperwork may not be sufficient.

However, the important thing is that he has not exceeded the limits.
