Compliance meeting - ESA was created by CCapewell
Hi there

We recently won an appeal at a tribunal which said my husband would get ESA now for 2 years without any reviews but they changed him to the work related group because he hasn't got enough contributions. we didn't realise at the time that the group had been changed and the consequences of this. He's now been sent an appt for a compliance meeting. Do you know what this is? He's been told he has to attend and they are asking for bank statements etc. Does this mean the money will be stopped depending on savings etc?
Thanks

It may be a random selection or something has been flagged on his claim, there should be a contact number for the Compliance Officer, I would give them a call for more information.

ESA(IR) is dependant on your household income, your savings and assets, and any hours that your partner works. See

Asset and savings rule for ESA(IR)

24 hour work rule for ESA(IR)

Thank you. It looks as though they will stop my husbands money because I work 30 hrs a week. I am planning to retire in March next year - do you know would his money start again then as he is in the pension credit age and the tribunal said no reviews for 2 years?

Be aware, if you are working 24 hours or more a week then your husband should not have received Income Related ESA in the first place, so there may be issues of an overpayment and also a failure to declare his circumstances.

Ok thanks. We've not hidden anything but not been asked about it since the change and wasn't aware of this .

Change came into place on 16 November so not too bad If that's the case. Just feels like a total waste of time fighting for the payment as previously was contribution based and we didn't understand the change that they made at the outcome. They awarded sufficient points but said was capable of some sort of work although what I'm not sure as he has several complex health issues.
Thanks for the info.
