ESA3 help :( was created by Paco Lock
I won my tribunal and they put me in the 'support group' but received another 'no' letter from jobcenterplus.

Then I received an ESA3 form with no cover letter. Why do I have to fill this in?

I'm deeply depressed and thinking about giving up even though I thought I'd won , , ,

Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Welcome to Benefits and Work

Forgive me but I am confused by parts of your post. You say you won a Tribunal but the DWP then sent you a "no" letter. Could you explain this in more detail?

As to the ESA3, were you transferred from Incapacity Benefit to ESA? If you were then you may have been underpaid, see the following News Article

www.benefitsandwork.co.uk/news/3691-75-0...-owed-thousands-each

An ESA3 is being issued to claimants who the DWP think may have been effected.

If you weren't on IB then I would need to know more about your claim to understand why the ESA3 has been issued, but I can tell you that is in connection with your being paid Income Related ESA.

Hello Gordon,
Thanks for the reply and the links.
I won my tribunal on Nov 20th plus they put me in the Support Group which is the benefit I've on for many years. I was swapped from IB but that was a long time ago.
On Nov 26th I got a letter from the DWP saying that they can not pay me ESA from June 12th 2017. To continue I may need to attend a Work focus interview etc. If I don't agree get in touch within one month of the date of letter.
This is the identical letter I received on 11th June 2017 which is what started this whole process off................are they starting the whole process again?????
I phoned them 10 days after the Tribunal to ask what was going on, they said they're waiting for my ESA 3 form to be filled in. I told them I'd never received it so they resent it. I received it on Dec 2nd but had no letter with it to explain why I have to fill it in or the date I need to reply by.
I cannot work, I'm on the highest rate of DLA indefinitely. I've written to my MP and my GP is writing to our MP to express his displeasure as, in addition to degenerative disc disease for 10 years, my mental health is a bit broken at the moment.
Sorry if it's too much info, I've never been on a forum before.
Kind regards
Paco

My guess is that the Decision Notice from your appeal has crossed in the post with the letter about your receiving ESA.

I assume that you were receiving Contribution Based ESA, the payment of ESA(CB) is limited to 365 days for claimants not in the Support Group, after this they can receive Income Related ESA if they are eligible for it The ESA3 is to check this eligibility.

However, as your appeal has placed you in the SG you should be able to receive your ESA(CB) again, although you might be eligible for ESA(IR) as well so it is worth your filling in the ESA3.

Unfortunately you will have to wait for the DWP to process your Tribunal result, this usually takes 5-8 weeks so it may be the New Year before you hear from them. It is well worth your keeping your MP chasing the DWP as it may speed the process.
