Thanks Gordon. My hubby was on PIP after acute cardiac problems following on with open heart surgery. His original problem was partly corrected but it left him with severe heart failure. He does function reasonably well but he’s on quite a lot of medication which he needs help with. Also has anxiety problems some of which is due to medication. He had his PIP assessment but the lead up to it was very stressful for him and I was concerned about him at the time. As you can guess, he was turned down. He does not want to appeal as he just couldn’t cope with a tribunal and I would be fearful of this affecting his health. However, he turns 65 soon and I wondered whether Attendance allowance might be a little easier for him to claim. I know the claim form is more detailed but if we send in as much medical information as we can, might they be more likely to make a decision without a medical? & if he did have to have one, have I read correctly that it’s likely to be a home visit. I think he might cope with this better.

Your options are

- Appeal the current Decision, you can do this at any time up to 13 months after the Decision.

- Make a new claim for PIP before he turns 65.

- Claim Attendance Allowance when he turns 65.

You may find AA easier to claim as it might fit his problems better than PIP, but be aware;

- although it uses the same criteria as DLA, there is an element of adjustment for the claimants age, so it is usually more difficult to award than DLA

- There is no mobility component

- Awards are based on the time that care is needed, so the lower rate, the same as PIP Standard is awarded for substantial care during the day OR the night, he can only receive the higher rate if he has substantial care needs both day AND night.

He won’t appeal Gordon because of the “ court” element. I don’t think the mobility component would apply any more as the operation eased the breathlessness. His needs are more supervision of his medication, dealing with the side effects and his anxieties and being available during the night for his several toilet trips as he gets disorientated. So I think AA would be more appropriate anyway.

It's entirely up to your husband but he can make a Paper appeal that he does not have to attend.
