PIP Appeal - do it quickly because of illness

Hi, I've spent 8 months trawling through PIP and Reconsideration to get no award as yet. Its been very long-drawn out.

I have been very ill last 6 weeks and have only 2 days left to Appeal.

In my reconsideration, nearly all my points were simply ignored.

For the Appeal please could you advise me:

(a) Can I repeat Reconsidertion points? As these have been mainly unanswered and remain backbone of my appeal. I am also too ill just to spend weeks trying to read and understand everything, again.

(b) Do I have to tell them in advance its probably going to be a paper Appeal - I am not sure I will be well enough to physically attend?

You can repeat the arguments that you used for the MR, just understand that you do not need to go into detail on the SSCS1 as to why you are appealing, we recommend doing this in a formal submission that you can send once your appeal has been accepted and the DWP have sent you a copy of their own submission.

There is a template request in the PIP submissions document.

I would advise you to request an Oral hearing that you will attend on the SSCS1, you can change your mind at any time and opt for a Paper hearing that you will not be at, doing so avoids the time constraints that are associated with a Paper hearing and will remove any anxiety that you might have in getting everything ready for a particular date.

Well, I completed Appeal form as best I could and will send off today, as its the last day. I have taken your advice and chosen an oral hearing, in case I change my mind nearer the time.

Can I ask please:

(1) At what point should I inform the Court if I decide I am too ill to attend in person and need a paper hearing instead?

(2) If I send of Appeal form today, do you know roughly how long it might take re. process to get an actual Appeal Tribunal date? I hear it can be months and months.

I would wait until you have gathered all of your evidence and sent it and any further testimony to the Tribunal Service before you notify them that you want to switch to a Paper hearing.

Paper hearings are usually heard quicker than Oral ones but you won't be told when yours is scheduled for, just the Decision once it has been held. I would think that you are looking at minimum wait of about three months. You can contact the TS and they should be able to give you a beet er idea of wait times for your area.

I'll probably wait till they give me a "proper" date for hearing, and then inform them if I am too unwell around that time.

As far as evidence is concerned, I have given them all the evidence I have - there is nothing left to give. So I will just have to live by decision based on what I have given them so far, however that falls.
