When to challenge PIP report

When to challenge PIP report was created by Debs424
I had my PIP medical a couple of weeks ago and requested a copy of the medical report. It has already arrived. I am definitely going to challenge the content as it contains several omissions etc. I’m sure I read somewhere that you can challenge prior to receiving a decision letter. Is this correct? If that is right how do I do that? (It is quite possible that I might have muddled myself on this). Many thanks.

Debs

There is a narrow window in which you can write to the Decision Maker to address any issues that you perceive with the Assessment report, before they actually make a Decision.

If you do then try and stick to issues that are directly connected with your scoring points, there may be lots of problems with the report, highlighting those that do not lead to points, will simply dilute your message and make it less likely that the DM will pay attention to what you are saying.

Thank you Gordon for your speedy response.

Just a couple of quick questions. Sorry. If I try this can I still ask for an MR is the decision remains unchanged? Should I phone to talk to the decision maker or should I write?

Thank you.

Writing to the DM before the Decision is made will have no impact on your requesting an MR afterwards, if needed.

Speaking to the DM is probably better if you are confident that you can put your points across to them on the phone, but you may struggle to actually speak to them before they make a Decision. A reasonable half way house is to write and then phone the PIP Helpline to say that you have written, asking (a) that the Decision is delayed until they have read your letter and (b), inviting the DM to contact you about it's contents. If you do the latter then keep a copy of your letter close to hand.

Thank you again Gordon.

I think the second option is better for me as I can find calls quite stressful.

I’ll take on board your advise about sticking to a couple of pertinent points for this.

Fingers crossed!

Morning Gordon,

Thank you so much for your advise yesterday. Thought I’d update you.

I rang the PIP helpline and spoke to a very helpful lady. She confirmed no decision has been made yet and said there was no need to write as she could deal with it for me. I told her the assessment had been recorded and the report did not reflect what had been discussed. She then took notes of the four errors/omissions I considered needed highlighting on my medical report.. She said she’d email the decision maker and ask them to take these into account and suggest they listen to the recording before reaching their decision.

She advised I should hear in about two to three weeks and wished me luck for a great decision. I’ll keep you posted as to the outcome.
