Happy New Year to all who run and help with this site and for giving your time to help and advice. I for one am still very grateful the site is still here and fully active and independent of the DWP and Government. Thank you seems a very small word but please know it means a lot x

Mine is a query re should I have really have been called at short notice to attend a Atos PIP Medical Assessment? recently I suffered a heart attack and was discharged from hospital on 8th Nov had to undergo numerous tests as my health is complex and complicated with other pre-existing conditions and also surviving a sub-massive pulmonary embolism twelve months earlier and placed on warfarin for life. Specialised are still trying to find a cause and I remain high risk of further PE and heart attack. Although DWP are aware of this they still had me meet a deadline to complete PIP forms by the 15th December or my DLA would end. CAB helped to complete that and then a few days ago I had a letter advising me to attend for the Health Medical Assessment tomorrow, 5th January I am also due to see another consultant on Monday to try to establish diagnosis. and more follow up and test due. The stress is obviously not helping my symptoms. It all just feels so illegal as medically your told to avoid stressful situations and yet Atos Medical professional have decided to make me attend tomorrow.
I had read somewhere there is guidelines that ATOS must follow before calling claimants in for medical assessments and wondered if I fitted into a high risk category that should have been followed and checked and referred for decision based on the claim form and all the medical information provided and then referred to DWP Decision maker.

Best Wishes

You say that the DPW have knowledge of your problems but do ATOS?

I'm afraid you are not going to avoid an assessment without the assistance of your GP, they need to write to ATOS explaining why it would be dangerous to your health if you were required to attend a face to face assessment .

Providing this was the first appointment you have been given then you can move the date to give you time to speak to your GP, however, you must attend the new appointment unless the requirement is removed by ATOS.

Hi Gordon yes both DWP and ATOS of my medical history. I had not even thought of asking for a type of letter from my GP to Atos re dangerous to my health. I had tried to see my GP to explain situation but sadly with it all happening over the festive season and priority on my other medical appointments I did not manage until today, and it was busy. I was overwhelmed in GP`s and some shown flu type symptoms, i really wanted to get back home. I mentioned the Atos Medical appointment, my GP looked shocked and printed off a few recent medical letters, he also checked my Glyceryl Trinitrate, I got all upset and forgot to ask him for a medical type note, but due to my symptoms he was also busy on his computer arranging further blood tests and a 24 hour ECG , he has told me to go straight to A&E if chest pains and palpitations persist but I forgot to get it in writing.
When I received the letter in the post around the 29th December dated 24th December and to attend on the 5th January 2018 I was just in shock at how little time I had to prepare, also I fear my benefit ending especially with my medical conditions, my CAB Advisor through GP outreach scheme is away for two weeks and he completed the PIP form for me to which I do not have a copy. I believe CAB Advisor thought there were delays on being called for medical and if I would actually be called at all considering amount of medical information. Although CAB did explains that majority in transition from DLA to PIP are being requested to attend Medical.
I fear cancelling in case I cannot make it to another re-arranged one or they try and send me to a different area, or they stop my benefit. I am confused and exhausted.

I'm afraid you need to make a decision about what you are going to do, if you don't attend the current appointment then the most likely result is that you claim will be closed and the only way to avoid the appointment if for your GP to get involved,
