Hello
I am currently in the support group on contributionary ESA from April 2016, I have a very complex medical condition and think I may have got it under regulation 35? I’m not sure. I am worried now when I am next review ed that this regulation has now fallen and I will not be placed back in support group. I ve had a brain tumour, spinal tumour and in lot of pain and also throat tumour, medical accident resulted in further surgery which caused lymphoedma and swallowing difficulties, please help, the stress is intolerable.

Regulation 35 has not been removed however the DWP guidance has been updated in the last year or so, whether this would effect your award or not is very difficult to comment on, you mention physical issues and the changes are primarily aimed at claimants with mental health issues.

Please could you explain regulation 35 as I am not sure exactly what it is. I have a long term health problem that involves pain, swallowing and depression, I am so confused atm. I didn’t write to find out what or how long they put me in support group as I did not know. This government has worn me down to the brink of wanting to take my own life. I am trying to work through these bad thoughts but it is a struggle.

Have a look at our ESA Claims due to mental health issues, there is a section that covers qualifying under the Substantial Risk rules which explain Regulation 35 (and 29).

I’ve read through both and physical and mental health but it has eluded me. I have been discharged from mental health team some years back as my problems are physical and the depression and anxiety are due to the physical health condition. Please direct me in right place. I sincerely apologise for my ignorance, but blind panick is creeping up on me !
