Further to my stepson's situation, in the meantime there has been a judicial review based on others in a similar predicament. It was in the High Court last week as some may know, TP vs DWP.

I don't know if the hearing has finished and if so, what the result is, but let's hope for a good result for the severely disabled people affected.

I believe the hearing has finished, a decision will likely be weeks rather than days.

So Amber Rudd has anounced that those migrated onto UC will finally be compensated for the reduction in benefit due to the loss of SDP. We are not clear on what level of compensation to expect or how to ensure my stepson is identified as one of those affected.
Should we send a message through his UC online account or should we contact DWP? Any advice welcome please

I'm sorry but this is not going to be sorted today, tomorrow or even this month. You can chase your JC+ but they may not even be aware of the change yet.

The rates are as follows

2. The transitional SDP amount, calculated by reference to the date of the determination, is—
(a) in the case of a single claimant—
(i) £120, if the LCWRA element is included in the award, or
(ii) £285, if the LCWRA element is not included in the award;
(b) in the case of joint claimants—
(i) £405, if the higher SDP rate was payable and no person has since become a carer for either of them,
(ii) £120, if paragraph (i) does not apply and the LCWRA element is included in the award in respect of either of them, or
(iii) £285, if paragraph (i) does not apply and the LCWRA element is not included in the award in respect of either of them.

Thanks once again. Having been on a reduced payment for some 22 months, we aren't expecting anything to happen all that quickly. However, we don't feel confident about how well or quickly he'll be identified as one of thise affected, so it seems sensible to contact them. As you say, perhaps let things start filtering down for a while so at least they'll know what we're talking about.
Thanks also for the figures, it's been difficult tracking down what to expect having lost about £40 per week. I'm still not clear on how much of that loss will be made up but I'll go over the calculation in the light of your reply.
