It's not going to be easy... on the balance of probabilities, I'd say that £330 a month is likely to greatly influence the decision to move and the choice of property suitable for stepson and the dog. Then the cost of adaptations made so they could live there safely and independently, meaning that a move to a cheaper property isn't practicable.
It may be worth applying for the recordings anyway and taking it from there perhaps.

Hi to all,

@ Gordon and Ali, i have read ali's post. And i can't quite understand why going onto UC if your say on ESA IR and in the support group, qualify the claimant to lose their disabiity premium?

It just doesn't make sense not alone is it justified. Given the fact the claimant in question has only moved home. And nothing else has changed!

I too was thinking of moving into another home, but in the same street where i live. But rerading this post has caused me some grave concern.

As this seems its giving the DWP the right to take away a claimants right of their disability premium.

Somewhere there must be legislations. & laws protecting the claimants from this ordeal, both financialy and mentaly.

This can only add more deterioration in a claimants condition/s, surely such cases should be brought to court, and not only should the claimant be re-instated his/ her disabiility premium. The claimant/s should get it back-dated, and the DWP or housing should pay the claimant compensation due to the suffering the claimant has had to endure.

I'm interesting to see how this develops.

Good luck Ali i hope the disability premium is payed back in full.

kind regards.

MrF

The issue is that the OP's son has moved from one Local Authority to another and it is this that has necessitated the claim for UC.

Unfortunately, these transfers due to a change of circumstances have no Transitional Protection.

Amongst the gems UC contains are no Premiums, and those who were pleased about the reversal in Tax Credits a year ago, learn that the change has already ben implemented in UC!

Hi Mr F and thanks Gordon. Yes, sadly my Stepson had no option but to migrate onto UC as he moved to one of the districts that is UC only. Hopefully people like yourself moving house in a non UC area will be spared the migration at least for now. Or even move before UC comes in!
Unfortunately the figures appear to be correct, UC claimants lose a huge amount if they had the premium payments. I have to stop our decision making about what to do now from being clouded by anger at how unfair it is in principle.
Even if we'd known that he'd lose the money, it would have been a horrible choice between being isolated and unsupported and moving to a much better place but taking the financial hit.
The abscence of transtional relief in this situation is a disgrace.

Just for the sake of accuracy, although my stepson loses £78 in premium payments, his UC calculation does pay a little more under his Limited capability for work & work related activity assessment. So the net loss is "only" £40 per week, or £173 per month.
