Huge Win for disabled people with mental health

Government has decided not to appeal high court ruling that said changes to legislation were discriminatory.

All those effected by the changes to PIP mobility for "psychological distress" should now see their cases automatically reviewed by the DWP and back paid.

Well done to campaigners and this site for putting pressure on the Government.

They are reviewing claims with Standard Mobility but beyond that we don't know.

I have spoken to a DWP PIP manager yesterday. They have hired a temp team of staff to comb through payments starting from when the regulations changed.

You do not need to have taken your claim to a tribunal or MR stage. They are reviewing all cases, even without standard mobility having been awarded. They said it will take months and months to get through all claims but obviously the earlier you applied since the regulations changed the quicker the process will be.

If you haven't heard anything in a few months then they suggest you phone them.

My adult son used to get low rate mobility along with his DLA, he has several mental health issues. He got put on to PIP around 18 months ago but wasn't awarded mobility when this changed Does anyone know if this type of case will be looked at again by DWP.
