Hello all, I am sorry if this is a duplication, I have read the PIP appeals locked topic, but I just wished to cover some burning issues. I am due to go to an appeal next month with a family member very brief circumstances, on application claimant was awarded 0 points, after the mandatory reconsideration gained10 pts for mobility and 7 pts for Daily activities. As you can see to go from 0 to 17 is a considerable alteration. Can you give some advice for the appeal - dos and donts and the equitte for the 'court' Thank you in anticipation.

The first thing to consider is what award you can reasonably attain, then work out how you are going to do this. Appeals are all about the claimant showing that they meet the criteria so make sure that you and more importantly the claimant, understand what that criteria is.

The panel will be asking the claimant about their day to day issues and specifically about the PIP activities. Their questioning will be robust and they may come back to some issues from a different point of view but understand that they are not trying to trick anyone, just ensure that they understand the claimants problems and make sure that they are genuine.

If you are attending as well then you may be given a chance to speak as well, at the end of the hearing, it may help you if you prepare a bullet list of points that you want get across, cross them off as the hearing proceeds so that you can deal with the ones that are left.

Although it is considerably more informal this is still a Court of Law and you must respect the instruction of the Judge in charge of the hearing, it may be tempting to add comment to the statements of the claimant. but be aware the panel may not want to hear you at that time, basically if you are told to be quiet then shut up until asked :)

For dress I would say business casual, but if the claimant has problems with Dressing and/or Bathing then they should not change their routine just becuase of the appeal.

Do a daily diary so they can see what happens each day. The more you can tell them about daily activities and the problems they have with them the better.
