Hi,

On 14th November 2017 I received an ESA50 for my ESA claim. I duly returned this on 6th December 2017 by Special Delivery and they received it the next day.

Today I received another ESA50 in the post, despite not hearing an outcome from my claim. I spoke to DWP on the phone and they said I needed to contact Medical Services and they provided a number. I called them, they said they received the original ESA50 and associated documents, contacted my doctor, decided they did not need me to attend a medical, and passed the file back to DWP.

Then I called DWP back and they indicated it had only been passed to a Decision Maker today. As yet there is no decision on my claim. What should I do with the second ESA50 as the person from Medical Services said I do not need to return it as they received and dealt with the original?

Also, is it looking good that they have passed the file to DWP without me attending a medical? Can they make a decision not to make me an award without calling me to a medical?

Thanks for your time please help me out.

This second ESA50 appears to have been issued in error, but I would get the DWP to confirm that you do not need to complete it, the processes for not returning a form can be triggered automatically and you could end up with the left hand not knowing what the right is doing.

Hi Gordon,

Medical Services did note there was a note on the system saying it had been sent in error. However, to be safe I will contact them in a couple of weeks when hopefully they’ll have made a decision. I remember I returned my form quite close to the deadline last time and they sent a reminder out with a week to go, but I suppose I will receive that if it’s not been cancelled.

Anyway other than that it looks promising does it not as they haven’t called me for a medical assessment?

Hi again,

I did write to DWP regarding this asking for them to confirm in writing that I don’t need to return the second, erroneous questionnaire. They have not replied. I’m really worried about it and don’t know what to do really.

They still haven’t sent me anything about a decision on my claim either.

Any help or advice appreciated.

If you can ring them or get someone to do it for you then I would.

Hi Gordon,

I have phoned them in the between making that post and just got off phone now. They (DWP not their Medical Services) confirmed that I do not need to return another ESA50. However, they said no decision has yet been made on the claim. I’m very worried about it naturally. He said he would pass it to a Decision Maker and I could expect an outcome in 10 working days. Is that the norm? I last contacted them 25th January and they told me it was with a Decision Maker then. I’m sick of getting mixed messages depending on who I speak to.

Further advice gratefully received.
