failure to record assessment was created by Nev
last Friday 26/01/2018 my wife went for ESA assessment, we had booked for it to be recorded, received confirmation of this and signed form at assessment centre upon arrival confirming it was to be recorded. When interviewer got her in room he said it didn't need recording and proceeded without recording. What is my best course of action. Regards Nev Robb

The complaint is separate from the Decision process and would be about the failure to record, if you are unhappy with the report when you see it then this could be a second complaint.

Just received phone call from DWP, (yes 3.15 pm Sunday) asessment date 26/01/2018, claim ended did not meet criteria. We are asking for mandatory reconsideration, can I claim UC for myself in the meantime without affecting my wife been put back on ESA if successful. I understand that if she claims UC now she won't be able to go back on ESA is that correct? I retire in 3month so obviously nobody will give me a job. Regards Nev.

Only if she was receiving Contribution Based ESA, Universal Credit is claimed as a household so she will be considered part of you UC claim if she was receiving Income Related ESA.
