I was only here 2 months ago to thank you after an 18 month fight to get my ESA support group reinstated and im really angry with the DWP that im already having to come back here but it seems despite being in the support group with a recommendation from the Courts for them not to contact me for 2 years minimum that they are starting up again.

They received a ESA50 from me through my welfare advisor after the tribunal to ensure I received full benefits and back pay - so obviously I am up to date on my personal details, despite this I have been called for a 'compliance interview' to 'ensure their records are up to date' they have refused to communicate with me for any information they feel is outstanding via letter or my advisor. There is no reason for this interview, what is more I have previously been put through this and after several months with no benefits they backtracked and said there was no reason for them to force me into a compliance interview in the first place.

I am straight back into the nightmare from before and at this point I have had enough - I need to know if this is a backdoor way to harass people on ESA in the support group not currently covered by regulations because I know there is law out there that stops them from calling ESA support group people into meetings normally, what are the regulations on 'compliance'? if they refuse to make reasonable adjustments are they discriminating? how can this type of interview be allowed but not any other type? I need information as im going through an Ombudsman complaint and want to add this new issue if I have anything that can back up my position.

I'm sorry about the ESA50, unfortunately the Tribunal recommendation is not binding on the DWP.

I'm afraid I not sure what Regulations cover compliance interviews if any actually do, I've found the following

Hi Rococo,

The compliance interview may, and probably is, unrelated to your support group entitlement. People in the SG are excused from work-focused interviews and work-related activity but compliance interviews are unrelated so anybody on benefit is required to attend them.

It could be the result of a malicious allegation or just an abnormality in their records. Try not to worry until you know what it is, and good luck.
