CAB appointment and health assessment

Hi everyone,
I had an appointment at the CAB the other day regarding my forthcoming appeal as asked for any assistance they could give me.
Everything went fine regarding most of it.
However, when i mentioned about certain issues I had at my health assessment such as in my medical report things like referring to my mobility using statements like "on a typical day" I dont have a typical day.
Also in the report saying I can sit for up to an hour without having to take a rest. This is also incorrect.
I could continue with these anomalies in my medical report.
The query I have is this.
The benefit advisor at the CAB said that it would not be beneficial at my appeal to tear apart the medical assessment which I feel would be vital aspects to bring up at the appeal as the whole emphasis due to assumption, omission and generalizing of the report gave an inaccurate representation of my health conditions.
Any advise please ?
Many thanks,
Mr S. :-)

hello mr s,

Your appeal is your opportunity to speak regarding the problems you face. No useful purpose will be served by 'tearing apart' the report. What you need to do is go through the assessment report and highlight the areas where you have scored less than you thought with the reasons for this. For instance the assessor may have said something like "I saw mr s walk from his car to the assessment centre which is 100 metres and he did not appear to have any problems with this. If you were challenging something like this you could respond by saying. The assessor stated that he saw me walk across the car park but he did not document that I stopped and rested because of the chest pain every 10 metres. This is just an example of the type of challenge you should make. No weight will be given to you just saying you don't agree with what the assessor has said.

Hi Izzy 1010,
Thank you for your reply.
In essence what you are saying is to be objective as opposed to subjective ?
An example being ,
Through the whole medical assessment I was constantly supporting my right hand side with my arm on the side of the chair while sitting through the duration of the assessment but this was not mentioned in the report.
Correct ?
Thanks again,
Mr S.

Whoops,
I forgot to mention that I was unable to sit for more than 20 mins ish before needing to rise from the chair and also change my sitting position constantly trying to find a comfortable way to sit.

Yes try to stick with matters of fact rather than arguing with the assessors opinions directly, also only raise issues that are likely to help you with scoring points.

If this is for ESA then the Standing and Sitting activity allows you to move between the two as many times as you need to, the clock does stop until you move away from the notional workstation.
