Dear all I just wanted to share my experience of a DLA to PIP appeal hearing.
I need to explain I have been on DLA at lower rate for both components for some 18 years
When they decided to transfer DLA to PIP in 2013 I was under 65 by the time I got the forms last February I was over 65.
I got 6 points at the face to face for daily living only.
At appeal which I believe is supposed to be independent I felt that the panel had decided to squash all my points.
They ignored eveidence from consultants GP and research nurse,and I was told they didn’t believe the level of fatigue and they didn’t believe I was not driving now because of severe fatigue memory and concentration problems which all 3 medical letters had confirmed.
The doctor instead of been understanding and drawing out info as to my problems was very aggressive and confrontational.
I had a 80 minute grilling which was exhausting and extremely scary.
I just wonder if it is because by the time the DWP I was over 65 but they had to do the DLA to PIP assessment.
Anyone else had a bad experience with a panel so much so that you don’t feel you carnt function or have been heard .

Thank you Gordon,yes they told me on the day they didn’t believe I was fatigued for 50% of the time and they didn’t believe I no longer drive my car because I am too exhausted have memory problems and cannot concentrate.
Even though I had medical evidence that Fatigue ,memory and concentration problems are all significant in my illnesses,which I may add can be life limiting it or fatal.

You do have the option of pursuing your current claim further but only if you can show that there has been an Error of Law in the making of the Decision, not because you disagree with it.

What is an Error of Law?

Alternatively you can make a new claim for PIP, there is no waiting time, maybe learning from what happened with this claim.

I cannot make another claim as I am now over 65 it was my last chance they were transferring me from DLA to PIP.
The solicitor has asked for the reasons of the decision so he can have a look to see if it is viable to take any further.
I did believe that theses appeal hearings were not adversarial but this certainly was.
