HI All.. I am in receipt of Contribution -Based and Income -Related ESA and Support Allowance. (I've been In the Support Group since being transferred over to ESA from Incapacity benefit way back when and I'm sure its down to the excellent guides and Information provided here ... So a Massive Thank You for all the good work you do). I have just found out I have a Private Pension that I could have been receiving from the age of 55 .. i am now 61 with numerous medical conditions hence my mind not being as focused as it should be i guess. Anyhow, I am now panicking that because i haven't taken up the pension will I now be found to have Notional Income and get into trouble for not taking it up? Am I obliged by law even though i am not at pensionable credit age right now to take the private pension or is the decision out of my hands? Can I if I want to, leave it alone till I get to my retirement age? As then I presume I will be taken off ESA and I will claim my old age pension at 66. The pension is a Fixed Rate Guaranteed Minimum Pension payable at about £25 per week for life (oh the joys of being able to live a life of luxury on that amount! ) I'm really at a loss after searching for a straight answer what I should do next. I hate the thought of contacting the DWP without a need for it. Hope my question makes sense and Thanks in anticipation of any advice, it will be gratefully recieved.

The pension will not be taken as Notional Income until you reach the age when you would be entitled to Pension Credits, this is the date that either you reach PC age, or currently, the date that a woman born on the same day as you would.
