I am currently on ESA in the activity related group. I currently live in sheltered accommodation and receive housing benefit. I no longer live with my ex partner and moved because of the relationship breakdown and my health. However, I did declare to ESA the house I jointly own own is on the market for sale though not sold yet. Will this asset contribute to why they will not pay income related esa after 22 May? The local council is aware of the circumstances and still awarding me housing benefit. Will this stop after 22 May ? I am appealing the decision for the activity related group which I feel should be the support group. Any help please

You don't explain the relevance of the 22 May date?

It is possible for the capital from your house to be disregarded while it is being sold, you need to talk to the DWP about this. The normal disregard is 26 weeks but this can be extended by a Decision Maker.

Thanks for the prompt reply. I will have been receiving ESA for a year come 22 May 2018. From what I can gather contribution based ESA will stop then. Because of the house as an asset and above £16000 they sem to be saying I cannot get income related ESA. I will check with the DWP re disregarding the capital. Thank you
